Motorist Busted For DWI With Infant, Child In Car, Scarsdale Police Say

A wanted Westchester man driving with a blood alcohol content nearly double the legal limit with a 6-year-old and 9-month old child asleep in the car without safety belts is facing a series of charges after being busted in Scarsdale during an early morning speeding stop.

While on patrol shortly before 4 a.m. on Monday morning, a Scarsdale police officer stopped White Plains resident Javier Galeno Morales, 31, for speeding on Post Road after he drove through a red light at the intersection of Olmsted Road.

During the stop, the officer reported that Morales stated he had several beers in White Plains. While speaking with Morales, the officer stated that he “detected a strong odor of an alcoholic beverage” on his breath, and his eyes were “glassy and bloodshot.” There were also a child sleeping in the backseat with no seatbelt on and an infant in the lap of a woman who was not in a car seat.

Police said that Morales went on to fail multiple Standardized Field Sobriety Tests and a breathalyzer determined that he had a blood alcohol content of .14 percent - nearly double the legal limit - at the time of the traffic stop. After being arrested, a datamaster test at Scarsdale Police Headquarters determined his blood alcohol content was .16 percent, double the legal limit.

Further investigation found that Morales had an active warrant out for his arrest in White Plains for DWAI. Morales was arrested and charged with a felony count of aggravated driving while intoxicated with a child under the age of 16, and driving while intoxicated, a misdemeanor. Morales was also charged with two counts of driving with a back seat under the age of 4 without a restraint, moving from a lane unsafely and speeding. Morales is due to be arraigned on Monday afternoon after an Assistant District Attorney recommended $20,000 bail.
